DC Collaborative Privacy Policy
Effective 3-7-08

This Privacy Policy describes the types of personal and non-personal information we collect on www.dccollaborative.org (the “Site”), how we use such information and to whom and under what circumstances we may disclose it. By using the Site, you agree to the collection, use and disclosure of your personally identifiable information as described in this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Site.

Collection of Information

DC Collaborative only collects personal information from you when you: (1) contact us; (2) join our mailing list; and (4) donate online.

As part of the standard operation of the Site, we may collect certain non-personal information from you, including but not limited to your browser type, operating system, IP address and the domain name from which you accessed the Site. In addition, we may collect information about your browsing behavior, such as the date and time you visit the Site, the areas or pages of the Site that you visit, the amount of time you spend viewing the Site, the number of times you return to the Site and other click-stream data. We use this information for internal reporting purposes only. We may use cookies to collect the non-personal information described above. A cookie is a small text file that may be stored on the hard drive of your computer when you access the Site. You are free to decline cookies. We may disclose information collected from and about you : (1) to our service providers, to perform a technical support function for us; (2) as necessary if we believe that there has been a violation of the Site Terms of Use or of our rights or the rights of any third party; (3) to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and (4) in the event that our organization, or substantially all of its assets, are acquired, your personal information may be one of the transferred assets.

We have taken certain physical, electronic, contractual and managerial steps to safeguard and secure the information we collect from Site visitors. We use our best efforts to respect and protect the privacy of our online visitors. At our Site, we do not collect personally identifiable information from you unless you provide it to us voluntarily and knowingly. We do not sell information you provide to us online to third parties.

Children’s Privacy

The Site does not target, and we do not knowingly collect personal information from, children under 13.

Terms of Use

This Terms of Use Agreement (this “Agreement”), states the terms and conditions under which you may use this Web site (the “Site”). Please read this Agreement carefully. This Site contains information relating to DC Collaborative (“DC Collaborative” or “We”) in the form of text, graphics, news, reports, and other materials (collectively, “Content”). By accessing, browsing and/or using this Site you acknowledge that you have read, understood and agree to be legally bound by this Agreement. If you do not accept this Agreement (and therefore do not agree to by bound by this Agreement), do not use this Site.

We reserve the right to amend this Agreement at any time by posting the amended terms on our Site. The modified Agreement will be effective immediately upon posting and you agree to the new posted Agreement by continuing to use the Site. You are responsible for staying informed of any changes. DC Collaborative reserves the right, in its sole discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of our Site or the Content, at any time and for any reason without prior notice or liability. DC Collaborative reserves the right to change, suspend, or discontinue all or any part of this Site or the content at any time without prior notice or liability.


User Must Comply with Applicable Laws

This Site is based in Washington, DC. DC Collaborative makes no claims concerning whether the Content may be downloaded or are appropriate for use outside of the United States. If you access this Site from outside of the United States, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction.


Miscellaneous

In the event that any portion of the Agreement is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect. The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Agreement. DC Collaborative failure to enforce any provision of this Agreement will not constitute a waiver of its right to subsequently enforce such provision or any other provision of this Agreement. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement. The Agreement shall be governed by and construed in accordance with the laws of the District of Columbia, except with regard to its conflicts of law rules. Any action relating to the Content, Site or this Agreement must be brought in the federal or state courts located in Washington, DC, and you hereby irrevocably consent to the jurisdiction of such courts. Any cause of action you may have with respect to the Content, Site or this Agreement must be commenced within one (1) year after the claim or cause of action arose, or be barred. This Agreement contains the entire agreement of the parties for this Site and supersedes all existing agreements and all other oral, written or other communication between the parties concerning its subject matter. You agree to use the Content and Site only for lawful purposes. You are prohibited from any use of the Content or Site that would constitute an illegal offense, give rise to liability or otherwise violate any applicable local, state, national or international law or regulation.
